Section 10.25.01.08 - Application and Enrollment of Additional Employees During the Policy Year

A. A newly hired eligible employee of an enrolled employer, an employee who becomes an eligible employee during the policy year, or an eligible employee who qualifies for a special enrollment period under 29 U.S.C. § 1181(f) is eligible to be enrolled in the Premium Subsidy Program during the policy year under the terms established at the beginning of the policy year, unless either:

(1) The participating carrier recalculates premiums charged to the enrolled employer; or

(2) The Premium Subsidy Program is closed to registration of additional employees of enrolled employers under Regulation .19 of this chapter.

B. The additional employee shall complete and sign the employee subsidy application required under Regulation .07 of this chapter.

C. The participating carrier's procedures and the written participation agreement determines whether the licensed insurance producer, the subsidy administrator, or the participating carrier shall enter the information from the additional employee's subsidy application in the Commission registry to register the additional employee to receive the premium subsidy.

D. If the participating carrier recalculates the premium rates charged to the enrolled employer, the employer shall complete the renewal application required under Regulation .09 of this chapter, including information about all current eligible employees. In this case, the total premium subsidy shall be recalculated for the small employer and eligible employees.
