A. Application for License.

(1) A person desiring to conduct, operate, or maintain a nursing referral service agency in this State shall file an application with the Secretary, on the written or electronic form provided by the Secretary.

(2) The application for licensure shall contain the name and address of each officer and the director of the nursing referral service agency.

(3) Along with the application, the applicant shall submit a:
(a) Nonrefundable 3-year license fee of $1,000 payable to the Department; and

(b) Copy of the agency's policies and procedures as specified in Regulation .08B(1) of this chapter.

B. Additional Requirements. The applicant shall:

(1) Demonstrate compliance with all applicable federal, State, and local laws and regulations; and

(2) Maintain records to support compliance with the regulations of this chapter and make the records available to the Department upon request.

C. After reviewing the application for licensure, the Secretary shall:

(1) Approve the application and issue a 3-year license to the applicant if the applicant complies with all requirements of this chapter; or

(2) Deny the application if the applicant does not comply with the requirements of this chapter.

D. A 3-year license expires 3 years from the date of its issuance, unless it is otherwise revoked or suspended by the Department.

E. License Renewal.

(1) The agency shall file an application for relicensure on the written or electronic form provided by the Secretary at least 60 days before the expiration of its current license.

(2) A licensee shall submit to the Department:
(a) An application for license renewal;

(b) A nonrefundable license renewal fee of $1,000 payable to the Department; and

(c) Updates, if any, to the agency's policies and procedures as specified in Regulation .08B(1) of this chapter.
