Section 09.32.02.17 - Requirement for Earning Wages before Second Benefit Year

A. If a claimant receives benefits during a benefit year, the claimant may not be entitled to receive benefits in a subsequent benefit year unless the claimant earned wages after the beginning of the first benefit year as a result of performing services in insured work, and the wages are equal to not less than 10 times the claimant's weekly benefit amount.

B. Special pay, severance pay, vacation pay, holiday pay, or prior earnings paid to a claimant at or after separation from employment do not constitute wages as a result of performing services in insured work.

C. Remuneration earned by a claimant for performing services in another state in insured work as defined by that state's unemployment insurance law shall be treated the same as remuneration earned for services performed in Maryland in covered employment.
