Section 09.19.06.01 - Contested Case Hearings

A. Except as provided in §§B and C of this regulation, all contested case hearings before the Commission are governed by COMAR 09.01.02.

B. Contested case hearings before the Commission shall be conducted before the Real Estate Appraisal Hearing Board in accordance with Business Occupations and Professions Article, §§16-210 and 16-211, Annotated Code of Maryland.

C. In accordance with Business Occupations and Professions Article, §16-211(d), Annotated Code of Maryland, the Commission or any of its members may file an exception to the decision of the Hearing Board within 15 days after the filing of the Hearing Board's decision.

D. If a timely exception under §C of this regulation is filed, the Commission shall set the matter in for a hearing before the Commission.

E. All contested hearings delegated to the Office of Administrative Hearings are governed by COMAR 09.01.03.
