A. Signatures required. The signatures of all owners shall be required upon application for certificate of title or duplicate certificate of title.
B. Determination of type of ownership.
1. When an application for certificate of
title is filed by two or more persons, the Secretary of State will assume
common ownership in equal shares unless a contrary intention is
expressed.
2. In order to create a
joint ownership with right of survivorship, the application for certificate of
title must state "as joint tenants and not an tenants in common" or "as joint
tenants with rights of survivorship as such, and not as tenants in common," or
the application must use other language clearly expressing an intention to
create a joint tenancy.
