A. Submission of statistics
1. All
statistics reported by any dealer, harvester, business, person or vessel to the
Commissioner shall be provided to authorized personnel of the
Department.
2. All statistics
reported by any dealer, harvester, business, person or vessel to the
Commissioner to comply with reporting requirements, or under an agreement to
participate in a Department-led project for the purpose of developing or
testing new methodologies or technologies to provide pertinent data with
respect to the fisheries, are confidential data as provided by
12 MRS
§6173.
B. Collection agreements
1. The Commissioner may enter into an
agreement with a state or federal agency authorizing that agency to collect
statistics on behalf of the Commissioner.
2. The Department shall not enter into a
cooperative collection agreement with another state or federal agency unless
that agency has authority to protect the statistics from disclosure to the
public in a manner similar to that of the Department and in a manner consistent
with these regulations.
C. Safeguards
Appropriate safeguards and a control system as specified by Department directives or other Department internal procedures, shall apply to the collection and maintenance of all statistics so as to insure their confidentiality.
1. The control system
instituted to protect the confidentiality of statistics shall:
(a) Identify those persons who have routine
access to the statistics;
(b)
Contain procedures to identify non-routine users and their use of data;
and
(c) Provide for safeguarding
the data.
