Section 144-118-4.G - Retention of Records

4.G.1. Client records must:
a. Be retained for a period
that meets both federal and state regulations;
b. Be retained for at least seven (7) years
after the date of death or last discharge of the client. Records of a minor
child shall be retained until the child reaches the age of majority or seven
(7) years after the date of death or last discharge, whichever is longer;
4.G.2. Administrative records must include:
a. Minutes of committee
meetings, with the most recent twelve (12) months kept on active file, and the
most recent five (5) years retained;
b.
Consultant reports, with the most recent twelve (12) months kept
on active file, and the most recent seven (7) years retained;
c. Inservice Records, with three (3) years
retained.
d. Staffing schedules,
with five (5) years retained (for auditing purposes);
e. Menu plans, with thirty (30) days of plans
retained;
f.Financial records,
with five (5) years retained (for auditing purposes);
g. Reports of fire drills with twelve (12)
months retained;
h. Accident and
incident reports with five (5) years retained;
i. Utilization review reports kept together
for twelve (12) months, with five (5) years retained;
j. Terminated employee files, with three (3)
years retained.
4.H.3. Rebating Prohibited
No owner, administrator, employee or representative of a licensed facility may either directly or indirectly pay to, or receive from, any physician, organization, agency or other person any commission, bonus or gratuity for clients referred or services rendered.
