Section 137-16-04 - Hunter Orange Requirements for Hunting of Wild Birds and Wild Animals

1. Open Firearms Season on Deer: Any person who is utilizing a firearm or crossbow during the open firearms season on deer (including the muzzle-loading season) must wear two articles of hunter orange clothing in accordance with Title 12 M.R.S. §10001-32. and §11203, this includes persons hunting for moose during the open firearms season on deer.

2. Moose Hunting: Any person who hunts with a firearm or crossbow within any WMD open to moose hunting during the open season on moose shall wear one article of solidcolored hunter orange clothing, as defined in Title 12 M.R.S. §10001-32., which is in good and serviceable condition and which is visible from all sides, except two articles of hunter orange clothing must be worn when hunting moose during the open firearms season on deer in accordance with paragraph 1.

3. Exceptions

A. Religious Opposition to Hunter Orange Clothing: Persons who have a religious opposition as defined within 12 M.R.S. §11203 1-A may substitute articles of bright red clothing in place of hunter orange clothing.

B. Waterfowl Hunting: Persons hunting waterfowl from a boat or blind or in conjunction with waterfowl decoys are not required to wear hunter orange clothing as provided within 12 M.R.S. §11203.
