Chapter 4 - RULE GOVERNING HEARINGS ON APPEALS OF CERTAIN EMERGENCY OR ADMINISTRATIVE COMMISSIONER ORDERS
Section 096-4-9 - Impartiality

The hearing must be conducted in an impartial manner. Upon a timely allegation, made in good faith, of bias or of personal financial interest, direct or indirect, of a Presiding Officer or Board member in the proceedings, requesting that person disqualify themself, that person must determine the matter as part of the record. If the person alleged to be biased requests, an allegation must be reduced to writing by the person making the allegation with an adequate time for response on the record. The Presiding Officer or Board member to whom the charge of bias or of personal financial interest is directed may consult with the Office of the Attorney General or private counsel concerning the charge
