Chapter 382 - WIND ENERGY ACT STANDARDS
Section 096-382-1 - Applicability

This chapter applies to any and all portions of a proposed grid scale wind energy development that are proposed for location within an expedited permitting area pursuant to the Maine Wind Energy Act (WEA). Any portions of such a proposed development that are not located within an expedited permitting area will be reviewed under standards established pursuant to the Site Location of Development Act, the Natural Resources Protection Act, and other standards as appropriate. The Scenic Character, Shadow Flicker, Public Safety, and Decommissioning Standards herein also apply to small-scale wind energy developments pursuant to 35-A M.R.S. § 3456 and 38 M.R.S. §480-II.
