Section 302-50-1 - Advertising

A. Any person advertising an auction to be conducted in Maine, except as exempted by § 286, shall include in the advertisement the name and license number of the licensee who shall bear primary responsibility of the auction to the seller and the general public. If a number of licensees are listed in the ad, they shall be jointly and severally liable for the conduct of the auction as well as compliance with the contract pertaining to that auction, including any payment to any and all consignors.

B. The auctioneer shall not intentionally misrepresent in any advertisement the terms, conditions, merchandise and/or the nature of the sale.

C. The auctioneer shall promote and advertise the sale of personal and real property in a commercially reasonable manner.
