Section V-1709 - Adoption of Rules and Regulations

A. The commission shall adhere to the following procedure in the adoption of rules and regulations, or the amendments thereto.
1. Notice. Prior to the adoption of
any rule or regulation, each commission member shall be given at least 10 days'
notice of the intended action. Such notice shall include a detailed description
of the rules and regulations to be adopted, and the time and place where the
meeting shall be held in order to adopt same. The notice shall also be
published at least once in the official Louisiana
Journal.
2. Hearing. Prior
to the adoption of any such rules or regulations, the commission shall permit
any interested person to submit data, views or arguments, orally or in writing,
in support of or in opposition to the proposed rules and regulations. The
commission shall consider fully, all written and oral submissions respecting
the proposed rules or regulations, and upon request of any such interested
person, the commission shall, prior to the adoption of such rules or
regulations, issue a concise statement of the principal reasons for and against
the adoption of same.
3. Emergency
Rules. If the commission deems that an imminent peril to the public health,
safety or welfare requires adoption of a rule within fewer than 10 days'
notice, it may proceed without prior notice or hearing based upon any such
abbreviated notice that the commission deems appropriate and necessary and,
accordingly, may adopt an emergency rule. Such a rule shall not be effective
for a period longer than 120 days. However, the commission may concomitantly
proceed to adopt such rule or regulation in accordance with Paragraph 1 and 2
above.
4. Filing. A copy of the
rules and regulations or amendments thereof adopted by the commission shall be
forwarded to the office of the Secretary of State, who shall maintain a
permanent register of such rules and regulations, which shall be open to public
inspection.
5. Effective Date. Each
rule and regulation adopted pursuant hereto shall be effective 10 days after
the filing with the Secretary of State, unless the rules and regulations
provide for a later date. an emergency rule, however, shall be effective
immediately upon filing with the Secretary of State, provided that the
commission submits with the emergency rule or regulation, a brief statement of
the reasons why the rule or regulation must be adopted immediately.
