A. Title to real property and equipment acquired under a grant shall vest, upon acquisition, in the grantee.
1. Real Property. Land including
land improvements, structures and appurtenances thereto, but excluding movable
machinery and equipment.
a. The property
shall be used for the originally authorized purpose as long as needed for that
purpose. When no longer so needed, approval of the director of LRS may be
requested to use the property for other purposes. Use for other purposes shall
be limited to projects or programs serving LRS' clients.
b. When real property is no longer to be used
for the originally authorized purpose, the disposition instructions of LRS
shall be followed. Those instructions will provide for one of the following
alternatives.
i. The property shall be sold
and LRS shall be paid an amount computed by multiplying the federal share of
the property times the proceeds from sale. Proper sales procedures shall be
used that provide for competition to the extent practicable and result in the
highest possible return.
ii. The
recipient can retain title. If title is retained, LRS shall be paid an amount
computed by multiplying the market value of the property by the federal share
of the property.
iii. The recipient
shall transfer the title to an eligible nonfederal party named by
LRS.
iv. The grantee shall be
entitled to be paid an amount computed by multiplying the market value of the
property by the nonfederal share of the property.
2. Equipment
a. Tangible personal property having an
acquisition cost of $5,000 or more per unit.
b. Equipment shall be used by the recipient
in the project or program for which it was acquired as long as needed. When no
longer needed for the original project or program, the recipient shall use the
equipment in other projects or programs currently or previously sponsored by
LRS. When the recipient can no longer use the equipment it shall be made
available to other recipients of LRS grants.
c. Disposition of Equipment. When equipment
is no longer to be used in projects or programs sponsored by LRS, disposition
of the equipment shall be made according to LRS property control
procedures.
