A. The following aliens may be eligible for an indefinite period of time even though they are not qualified aliens.
1. Individuals
who are lawfully residing in the United States and were members of a Hmong or
Highland Laotians tribe at the time the tribe rendered assistance to the United
States personnel by taking part in a military rescue operation during the
Vietnam era beginning August 5, 1964 and ending May 7, 1975, as defined in
§101 of Title 38, United
States
Code; the spouse or an unmarried, dependent
child of such an individual; or the unremarried surviving spouse of such an
individual who is deceased.
2.
Individuals who are American Indian born in Canada to whom the provisions of
§289 of the Immigration and Nationality Act apply or who is a member of an
Indian tribe as defined in §4(e) of the Indian Self-Determination and Education
Assistance Act.
