A. Upon determination that a public water supply is not in compliance with the maximum contaminant levels or treatment technique requirements of the National Primary Drinking Water Regulations, variances and/or exemptions may be issued by the state health officer in accord with Sections 1415 of the Safe Drinking Water Act and Subpart K (Variances for Small System) of 40 CFR Part 142.

B. The owner of the public water supply which receives a variance and/or exemption shall fully and timely comply with all the terms and conditions of any compliance and/or implementation schedule specified by the state health officer in conjunction with the issuance of same.
