A. The use of any chemical preservative in or on any food or food product is prohibited, except as hereinafter provided:
1. sodium benzoate shall be permitted to be
used in foods or food products as a preservative, in amounts not to exceed 1/10
of 1 percent of the weight of the food or of the volume of the food in case of
fluids; provided the food or food product is properly labeled to show the
presence and amount of sodium benzoate; and provided, further, that such food
or food product cannot be satisfactorily kept from spoilage under good sanitary
methods without the addition of sodium benzoate within the above-prescribed
amount; and provided, further, that no definition or standard of identity has
been promulgated wherein chemical preservatives are specifically prohibited for
such food or food product.
