A. All nursing facilities licensed by the department shall comply with the rules, sanitary code and enforcement policies as promulgated by the Office of Public Health (OPH).
1. It shall be the primary
responsibility of OPH to determine if applicants are complying with those
requirements.
2. No initial license
shall be issued without the applicant furnishing an approval from OPH that such
applicant is complying with their provisions.
