A. In its application for a license, or upon renewal of its license, a provider may request a waiver of specific MIHC module licensing provisions.
1. The waiver request shall be submitted to
HSS, and shall provide a detailed description as to why the provider is
requesting that a certain licensing provision be waived.
2. HSS shall review such waiver request. Upon
a good cause showing, HSS, at its discretion, may grant such waiver, provided
that the health, safety, and welfare of the client is not deemed to be at risk
by such waiver of the provision(s).
