Section I-1325 - Sanctions

A. The provider will be subject to sanctions, penalties, or possible withdrawal of client for failure to comply with this policy or with requests issued by DHH pursuant to this policy. The severity of such action will depend on:
1. the nature of the violation (degree to
which a class member's safety. well-being and care have been
jeopardized):
2. the frequency of
the violation:
3. the persistent
failure to follow DHH/facility policy and procedure.
B. Penalties and/or sanctions include:
1. loss of funding;
2. closure;
3. cancellation of contract;
4. criminal charges;
5. fines up to $1,000 a day.
C. The state program office and/or the Gary W. Project Office will recommend sanctions to the secretary of DHH as appropriate.
