A. It is professional misconduct for an investigator to:
1. violate or attempt to violate the rules of
professional conduct or to knowingly assist or induce another to do so, or do
so through the acts of another;
2.
commit a criminal act or any other act that reflects adversely on the
investigator's honesty, trustworthiness or fitness as an investigator in other
respects;
3. engage in conduct
involving dishonesty, fraud, deceit, or misrepresentation;
4. except upon the expressed assertion of a
constitutional privilege, to fail to cooperate with the ethics committee in its
investigation of alleged misconduct; or
5. threaten to file criminal charges solely
to obtain an advantage in a civil matter.
