A. Issuing of Statements. The board may issue a declaratory statement on its own initiative or in response to a request for clarification of the effect of the provisions contained in the Practice Act, R.S. 37:2401 et seq., and/or the boards rules, LAC 46:LIV. Chapter 1 et seq.
1. A request for a declaratory statement is
made in the form of a letter to the board. The letter shall include, at
minimum:
a. the name and address of the
requester;
b. specific reference to
the statute or rule and regulation to which the request relates;
c. a concise statement of the manner in which
the requester is aggrieved by the rule or statute or by its potential
application to his concern.
2. The letter shall be considered by the
board within a reasonable period of time taking into consideration the
complexity of the issues raised and the board's meeting schedule.
3. The declaratory statement of the board in
response to the letter shall be in writing and shall be made available on the
board website.
