Section XV-6517 - Injunctive Relief

A. The office may request legal counsel or the attorney general of the state to institute a civil action for relief, including a permanent or temporary injunction, restraining order or any other order, in a state court of competent jurisdiction whenever the person to whom a notice of violation or order has been issued, either:

1. violates or fails or refuses to comply with any order or decision of the commissioner or an authorized representative of the commissioner under the Act or these regulations;

2. interferes with, hinders or delays the commissioner or an authorized representative of the commissioner in carrying out the provisions of the Act or these regulations;

3. refuses to admit an authorized representative of the commissioner to a mine;

4. refuses to permit inspection of a mine by an authorized representative of the commissioner;

5. refuses to furnish any required information or report;

6. refuses to permit access to or copying of any required records; or

7. refuses to permit inspection of monitoring equipment.
