A. The board may consider the following criteria when deciding whether to issue a license or a finding of suitability to conduct fantasy sport contest or whether to continue licensing or finding a person suitable to engage in fantasy sports contests. The various criteria set forth may not have the same importance in each instance. Other factors may present themselves in the consideration of licensing and a finding of suitability. The following criteria are not listed in order of priority:
1. applicant or licensee and its operation is
properly financed;
2. adequate
security. The board may consider whether the platform is designed and secured
in a manner that provides adequate security for all aspects of its operation
and for players;
3. character and
reputation. The board may consider the character and reputation of all persons
identified with the ownership and operation of the applicant or licensee and
their capability to comply with regulations and the Act; and
4. miscellaneous. The board may consider such
other factors as may arise in the circumstances presented.
