A. Severability
1. Nothing contained in these
regulations shall be so construed as to conflict with any provision of the Act
or any other applicable statute. If any regulation is held invalid by a final
order of a court of competent jurisdiction at the state or federal level, such
provision shall be deemed severed and the court's finding shall not be
construed to invalidate any other regulation.
B. Captions, Pronouns, and Gender
1. Captions appearing at the beginning of
regulations are descriptive only, are for convenient reference to the
regulations and in no way define, limit or describe the scope, intent or effect
of the regulation. Masculine or feminine pronouns or neuter gender may be used
interchangeably and the plural shall be substituted for the singular form and
vice versa, in any place or places in the regulations where the context
requires such substitution.
