A. Failure to comply with any of the provisions of these regulations or of the terms and conditions of any permit granted or order issued hereunder constitutes a violation of the Act.
B. Investigations into Reports of Violations
1.
Upon the receipt of any information concerning a violation of the requirements
of the Act or these regulations, the administrative authority shall cause an
investigation to be conducted into the alleged violation within seven
days.
2. All facts concerning any
violation developed in such an investigation shall be fully documented in a
report of investigation and presented to the administrative authority within
seven days of completion of the investigation. A copy of this report shall be
furnished to the Louisiana Department of Justice for use in any civil or
criminal proceedings under the Act.
C. Upon receipt of any report of investigation which substantiates a violation of the requirements of the Act or these regulations, the administrative authority shall commence enforcement proceedings under the Act.
