Section CXXXIX-1105 - Intervention Process for BESE-Authorized Charter Schools

A. The charter school performance compact may include an intervention process that articulates the steps the Department of Education may take should a school fall out of compliance with requirements outlined in the charter school performance compact, law, or BESE policy. The stages of the intervention process shall include, at a minimum:
1. good standing. All charter schools will
begin at this level;
2. notice of
concern. If the Department of Education receives a verified complaint or if
regular oversight generates significant concerns or questions, a school will
receive a notice of concern. The notice of concern will contain specific
actions and due dates required to remedy the concern. Upon remedying the
concern the school will return to good standing. One or more notices of concern
may lead to increased oversight by the Department of Education;
3. notice of breach. For significant,
intentional, or repeated non-compliance with requirements outlined in the
charter school performance compact, law, or BESE policy, or if a school fails
to correct a notice of concern, the school will be issued a notice of breach
that will contain specific actions and due dates required to remedy the breach.
The Department of Education will monitor the implementation of the steps
required to cure the breach. Once a school has fulfilled the notice of breach
requirements, the school will return to good standing. One or more notices of
breach may lead to increased oversight by the Department of
Education;
4. revocation review.
Upon failure to meet the requirements specified in the notice of breach, in
instances of ongoing and significant concerns, or when the safety, health, or
welfare of students is threatened, the department may initiate a revocation
review. The review may include additional visits to the school or an in-depth
audit to assess financial and/or organizational health. Findings from the
revocation review will determine whether the Department of Education shall
commence revocation proceedings or whether the school will be granted a new or
revised notice of breach.
