NECESSITY, FUNCTION AND CONFORMITY: KRS 351.175(3) requires the Department for Natural Resources to establish mine license fees. This administrative regulation establishes the fees to be charged for a license to operate a mine.
Section 1. The amount of the license fee for a mine shall be established as follows:
(1) The annual license fee for a new mine
shall be $300. A "new mine" shall include a mine which has previously produced
coal, but was not licensed and operating in the immediately previous
year.
(2) The annual license fee
for a mine licensed and producing coal in the immediately preceding calendar
year shall be as follows:
(a) Mines producing
100,000 tons or less in the previous year - $300.
(b) Mines producing more than 100,000 tons in
the previous year - $300, plus $100 for each additional 100,000 tons mined or
part thereof.
