Section 803 KAR 25:040 - Average weekly wage certification

RELATES TO: KRS 342.143

NECESSITY, FUNCTION, AND CONFORMITY: KRS 342.143 requires that the average weekly wage of the state be certified to the Executive Director of the Office of Workers' Claims by the Executive Director of the Office of Employment and Training in the Department for Workforce Investment, Education Cabinet, in a manner prescribed by the Executive Director of the Office of Workers' Claims by administrative regulation. The function of this administrative regulation is to prescribe this manner.

Section 1. Certification of Average Weekly Wage of the State.

(1) On or before September 1 of each year, the Executive Director of the Office of Employment and Training in the Department for Workforce Investment, Education Cabinet shall certify to the Executive Director of the Office of Worker's Claims the "average weekly wage of the state" for the preceding calendar year, pursuant to KRS 342.143.

(2)
(a) This certification shall include the mathematical calculation used in determining the average weekly wage in accordance with KRS 342.143; and

(b) The average weekly wage shall be certified in writing and mailed to the Executive Director of the Office of Workers' Claims.
