NECESSITY, FUNCTION, AND CONFORMITY: KRS 117.015(1)(a) authorizes the State Board of Elections to promulgate administrative regulations necessary to properly carry out its duties. KRS 116.048(1)(d) and 42 U.S.C. 1973gg-5(a)(2)(B) require the Secretary of State to designate as voter registration agencies those agencies that the Secretary determines to be state-funded programs primarily engaged in providing services to persons with disabilities. This administrative regulation sets forth disability service agencies designated to provide voter registration services.

Section 1. Definitions.

(1) "Designated agency" means a department, division, or office of state government, or a program supported by state funds which is designated by the Secretary of State through this administrative regulation to provide voter registration services according to KRS 116.048(1)(d).

(2) "Disability Service Agency" means a designated agency that provides state-funded programs primarily engaged in providing services to persons with disabilities.

Section 2. Disability Service Agencies. The following disability service agencies shall provide voter registration services to applicants for the following programs:

(1) Programs offered by the Office of Vocational Rehabilitation and Office for the Blind within the Education and Workforce Development Cabinet;

(2) Programs offered by the Commission for Children with Special Health Care Needs within the Cabinet for Health and Family Services;

(3) Programs offered by the Department for Aging and Independent Living within the Cabinet for Health and Family Services;

(4) Programs offered by the Department of Behavioral Health, Developmental and Intellectual Disabilities within the Cabinet for Health and Family Services; and

(5) Programs offered by the HIV/AIDS Branch of the Division of Epidemiology and Health Planning of the Department for Public Health within the Cabinet for Health and Family Services.
