NECESSITY, FUNCTION, AND CONFORMITY: In order to regulate the practice of selling and fitting hearing instruments, it is necessary to define terms related to the practice of fitting and selling hearing instruments. This administrative regulation establishes those terms and their definitions.
Section 1. In addition to the definitions in KRS 334.010, and, unless the context otherwise requires:
(1) "The time the buyer assumes any
financial obligation with respect to the purchase" shall be deemed to be the
moment when the buyer authorizes the purchase of the hearing
instrument.
(2) "Place of business"
means an established address where the client may have personal contact and
counsel with the fitter or seller of hearing instruments and obtain service
during normal business hours.
(3)
"Selling price" shall be the gross purchase price of the hearing instrument or
instruments less any discounts granted.
