Section 49-7-3 - Prerequisites to election

The commissioner will order that an all-union agreement authorization election be held if his investigation has revealed that:

(a) No question concerning representation is pending.

(b) The petitioning labor union is the presently designated representative of the collective bargaining unit.

(c) The petition filed shows interest by thirty percent (30%) of the employees in the appropriate collective bargaining unit.

(d) No valid secret ballot election authorizing an all-union agreement has been conducted in the past twelve (12) months among the employees in the unit covered by the petition.
