Section 49-31-8 - Joint employment by public employers in fire prevention and law enforcement activities; overtime

(a) A joint employment relationship exists between two (2) or more public employers when they agree to share the services of an employee when one employer shall act directly or indirectly in the interest of the other employer in relations with the employee when:

(1) The employers each have the right to control the job activities of the employee.

(2) The second employer is required by local ordinance or otherwise to hire the employee and such employment benefits both employers.

(b) The employees not otherwise exempt from K.S.A. 1978 Supp. 44-1201 through 44-1213 shall be paid overtime compensation by the primary employer for combined hours of work performed under joint employment relationships, except that employment with private employers shall not constitute a joint employment relationship under K.S.A. 1978 Supp. 44-1201 through 44-1213.
