Section 28-68-6 - Deductible payment

On initiation of corrective action by the department at a contaminated dry-cleaning site, the applicant shall pay to the department the applicable deductible, minus the reasonable, direct costs incurred by the applicant to collect the application information as specified in K.A.R. 28-68-5(f). The deductible shall be $5,000.00 for each dry-cleaning facility that has contributed to the contamination of the contaminated dry-cleaning site. Under the conditions specified in K.S.A. 65-34,148, and amendments thereto, the owner of any property that includes an existing or former dry-cleaning facility may be responsible for up to 100% of the costs of corrective action attributable to the owner.
