Section 28-35-192f - Exemptions; self-luminous products containing tritium, krypton-85 or promethium-147

(a) Each person that wants to manufacture, process, produce, or initially transfer for sale or distribution self-luminous products containing tritium, krypton-85, or promethium-147 for use as specified in this subsection shall apply for the license required by K.A.R. 28-35-175a and the registration required by K.A.R. 28-35-181u.

(b) Each person not subject to subsection (a) that acquires, possesses, uses, or transfers tritium, krypton-85, or promethium-147 in self-luminous products manufactured, processed, produced, imported, or transferred in accordance with a specific license issued by the nuclear regulatory commission pursuant to 10 C.F.R. 32.22 shall be exempt from the requirements of this regulation.

(c) The exemption in subsection (b) shall not apply to tritium, krypton-85, or promethium-147 in toys, adornments, or similar items.
