Section 28-29-80 - Annual reviews of the SWM plan

(a) Review.
(1) Each SWM committee, except as specified
in K.S.A.
65-3405 and amendments thereto, shall conduct
an annual review of the SWM plan.
(2) The review shall identify all changes
made to the SWM system of the county or region since adoption and approval of
the SWM plan, the last annual update, or the last five-year review, whichever
is most recent.
(b) Revision. If a revision of the SWM plan is required, the SWM committee, except as specified in K.S.A. 65-3405 and amendments thereto, shall follow the procedures specified in K.A.R. 28-29-82.
(c) Adoption. The county commission or governing body of the designated city shall inform the SWM committee of the adoption of the review.
(d) Submission.
(1) The results of the annual
review shall be submitted to the secretary on or before the anniversary date of
approval of the SWM plan or the last five-year review, whichever is more
recent.
(2) One of the following
groups shall submit the results of the annual review to the department:
(A) For individual county SWM plans without a
designated city, the county commission;
(B) for SWM plans with a designated city, the
governing body of the designated city; or
(C) for regional SWM plans, the SWM
committee.
(3) The
following documents shall be submitted to the department with the results of
the annual review:
(A) A list of the current
SWM committee members, as specified in K.A.R. 28-29-76; and
(B) a certification of adoption from the
county commission of each county participating in the SWM plan.
