Section 21-70-43 - Alterations; elevator exemption

(a) Installation of an elevator shall not be required in an altered facility that is less than three stories high or has less than 3,000 square feet per story, except with respect to:

(1) any public accommodation located in a shopping center or a shopping mall;

(2) the professional office of a health care provider; and

(3) any public transportation facility.

(b) The exemption provided in subsection (a) of this regulation shall not obviate or limit in any way the obligation to comply with the other accessibility requirements established by the act or these regulations.
