Section 129-6-94 - Non-medicaid determined eligibles; eligibility factors specific to persons living in nursing facilities for mental health

(a) To be eligible for participation in the medical assistance program under this regulation, each individual shall meet the following conditions:
(1) Meet the general
eligibility requirements of K.A.R. 129-6-50;
(2) be aged 21 or older and under the age of
65;
(3) have a "severe and
persistent mental illness," as defined in K.A.R. 30-10-1a;
(4) be otherwise eligible for medicaid;
and
(5) not meet the requirements
of K.A.R. 129-6-60(b) or 129-6-81(b).
(b) Eligibility shall be determined based on the financial eligibility standards and methodologies applicable to persons in institutional arrangements as specified in K.A.R. 129-6-42(c), 129-6-54(d), and 129-6-103(b).
(c) Whether an individual has a severe and persistent mental illness shall be determined by a qualified mental health professional employed by a participating mental health center, as defined in K.S.A. 59-2946 and amendments thereto.
