Section 112-10-11 - Posterior digital neurectomy

(a) Each person shall not deliver to a race track facility, enter or cause to be entered in any race, sell or offer for sale or act as a bloodstock agent in the sale of a horse that has been "nerved" or has had any nerve removed from its leg except as provided in article 112 of the Kansas administrative regulations.
(b) Any horse that has had a posterior digital neurectomy may be eligible to race if:
(1) An assistant animal health officer finds
that the loss of sensation resulting from the posterior digital neurectomy will
not endanger the horse or rider;
(2) an assistant animal health officer has
approved the presence of the horse at the race track facility;
(3) the horse is registered or eligible and
the racing secretary has been notified that the horse has been nerved at the
time the horse is admitted to the race track facility or while it is at the
race track facility; and
(4) the
fact the horse has been nerved is recorded on the horse's eligilility
certificate.
(c) Each posterior digital neurectomy that is performed at a race track facility shall be reported immediately to the racing secretary.
(d) Each horse shall not be eligible to race if it has had a neurectomy above the fetlock.
