Rule 871-25.11 - Prosecution for fraud (procedure)

(1) If prosecution is warranted, supportive documentation and evidence will be requested and thoroughly reviewed upon receipt by the investigator

(2) A handwriting sample will be taken from claimant when necessary and submitted for investigation.

(3) A summary of the case will be prepared and the case taken to the county attorney for filing of criminal charges.

(4) Upon request by the coimty attorney, the investigator may make recommendations regarding plea bargaining, dismissals, and sentencing and participate in the mediation process.

(5) Investigators may testify and produce evidence at district court and grand jury proceedings.

This rule is intended to implement Iowa Code sections 96.11(1) and 96.16(2).
