Rule 761-615.13 - Suspension of a Habitual Violator

(1) The department may suspend a person's license when the person is a habitual violator of the traffic laws. "Habitual violator" means that the person has been convicted of three or more moving violations committed within a 12-month period.

(2) The minimum suspension periods shall be as follows unless reduced by a driver's license hearing officer based on mitigating circumstances:

3 convictions in 12 months

90 days

4 convictions in 12 months

120 days

5 convictions in 12 months

150 days

6 convictions in 12 months

180 days

7 or more convictions in 12 months

1 year

(3) In this rule, speeding violations specified in Iowa Code section 321.210(2) "d" and violations under Iowa Code section 321.276 are not included.

This rule is intended to implement Iowa Code section 321.210.
