The board of directors of each school district and the authorities in charge of each nonpublic school shall, in collaboration with the department, ensure that each applicant and transfer student complies with the blood lead testing requirement according to subrule 67.6(1) or has a valid certificate of blood lead testing exemption on file.

(1) The board of directors of each school district and the authorities in charge of each nonpublic school shall ensure that the certificate of blood lead testing exemption is properly completed according to rule 641-67.4 (135).

(2) Within the constraints of the privacy rights of the parents or guardians and students, the local board of health, the department of education, and the department or its designee shall have the right to have access to the department's determination that a child has received a blood lead test and to the certificates of blood lead testing exemption of children enrolled in kindergarten.
