Rule 641-40.110 - Posting of Notices to Workers

(1) Each licensee or registrant, except those registrants with diagnostic X-ray systems, shall post current copies of the following documents:

a. This subrule and 641-Chapter 40;

b. The license, certificate of registration, conditions or documents incorporated into the license by reference and amendments thereto;

c. The operating procedures applicable to activities under the license or registration; and

d. Any notice of violation involving radiological working conditions, proposed imposition of civil penalty, or order issued pursuant to 641-Chapter 38, and any response from the licensee or registrant.

(2) If posting of a document specified in 40.110(1)"a", 40.110(1)"b " and 40.110(1)"c" is not practical, the licensee or registrant may post a notice which describes the document and states where it may be examined.

(3) Agency Form "Notice to Employees" shall be posted by each licensee or registrant.

(4) Agency documents posted pursuant to 40.110(1)"d" shall be posted within two working days after receipt of the documents from the agency; the licensee's or registrant's response, if any, shall be posted within two working days after dispatch from the licensee or registrant. Such documents shall remain posted for a minimum of five working days or until action correcting the violation has been completed, whichever is later.

(5) Documents, notices, or forms posted pursuant to 40.110(1) shall appear in a sufficient number of places to permit individuals engaged in work under the license or registration to observe them on the way to or from any particular work location to which the document applies, shall be conspicuous, and shall be replaced if defaced or altered.
