Any person under the board's jurisdiction that is affected by Iowa Code chapter 68B or 351-Chapter 8 may seek an advisory opinion from the board pursuant to rules 351-1.2 (68B) and 1.3(68B). The purpose of a board opinion is to apply a statute or rule to a particular factual situation. Advice contained in a board opinion, if followed, constitutes a defense to a subsequently filed complaint.
This rule is intended to implement Iowa Code section 68B.32A(12).
