Rule 282-11.3 - Jurisdictional Requirements

(1) The case must relate to alleged violation of the criteria of professional practices or the criteria of competent performance.

(2) The magnitude of the alleged violation must be adequate to warrant a hearing by the board.

(3) There must be sufficient evidence to support the complaint.

(4) The complaint must be filed by a person who has personal knowledge of an alleged violation and must include a concise statement of facts which clearly and specifically apprises the respondent of the details of the allegation(s).

(5) The complaint must be filed within three years of the occurrence of the conduct upon which it is based or discovery of the conduct by the complainant imless good cause can be shown for extension of this lunitation.

(6) The jurisdictional requirements must be met on the face of the complaint before the board may order an investigation of the allegation(s) of the complaint.

(7) As an additional factor, it should appear that a reasonable effort has been made to resolve the problem on the local level. However, the absence of such an effort shall not preclude investigation by the board.
