Rule 282-11.16 - Subpoenas

(1) Subpoenas. In connection with the investigation set forth in rule 282-11.5 (272), the board is authorized by law to subpoena books, papers, records and any other evidence to help it determine whether it should institute a contested case proceeding (hearing). After service of the hearing notification contemplated by rule 282-I1.7(I7A,272), the following procedures are available to the parties in order to obtain relevant and material evidence:
(2) Motion to quash or modify. The presiding officer may quash or modify a subpoena for any lawful reason upon motion in accordance with the Iowa Rules of Civil Procedure. A motion to quash or modify a subpoena shall be set for argument promptly.
