Rule 21-45.105 - Response by Peer Review Panel

The panel shall notify in writing the department and the Cornmercial applicator of its reCornmendations within 30 days of receipt of a request for review. Upon receipt of the panel's reCornmendations, the department and the Cornmercial applicator may reach an agreement on the amount of the civil penalty. If the parties do not agree, the department may initiate or continue the contested case proceeding. The department is not required to follow the reCornmendation of the panel as to assessment of the civil penalty. If the department does not receive a reCornmendation from the panel within 30 days of the panel's receipt of a request for review, it may proceed with the hearing.
