Rule 161-8.29 - Wages and Benefits

(1) While employers may reengineer the conditions of work for the disabled person, the salary paid to the person shall be no lower than the lowest listed on the applicable wage grade schedule.
(2) The wage schedule must be unrelated to the existence of physical or mental disabilities.
(3) It shall be an unfair employment practice for an employer to discriminate between persons who are disabled and those who are not, with regard to fringe benefits, unless there are bona fide underwriting criteria.
(4) A condition of disability shall not constitute a bona fide underwriting criteria in and of itself
