Chapter 4 - CONTESTED CASES
Rule 161-4.24 - Scope of review by commission

Universal Citation: IA Admin Code 161-4.24

Current through Register Vol. 46, No. 19, March 20, 2024

(1) In general. Whenever the commission reviews a proposed decision, it has all the power it would have in initially making the final decision. The commission may adopt, modify or reject the presiding officer's proposed decision or it may remand the case to the presiding officer for the taking of additional evidence and the making of any further proposed findings of fact, conclusions of law, or decision and order the commission deems necessary.

(2) Limitation of issues. Whenever the commission reviews a proposed decision it shall consider only those issues actually presented to the presiding officer unless the issue was one which either:

a. Was raised prior to the proposed decision by a party, but not ruled upon, or

b. Was discussed in the proposed decision, but not argued on brief by the parties.

This rule does not affect a party's right to seek disqualification of a commissioner under rule 161-4.13(17A) or 161-4.14(17A).
