Sec. 6.

(a) The department will determine, based upon the need determination process outlined in section 5 of this rule, the amount and method of distribution of any award from the fund. An applicant may not receive more than two thousand five hundred dollars ($2,500) in total assistance from the fund from the department. Any request for assistance in excess of two thousand five hundred dollars ($2,500) requires the approval of the commission.

(b) The commission may consider the following in its analysis of the applicant's request for funds in excess of two thousand five hundred dollars ($2,500):

(1) The department's eligibility determination of the applicant.

(2) Facts considered in the department's need determination review and award under sections 3 and 5 of this rule.

(3) The circumstances surrounding the applicant's hardship.

(4) Any substantive changes in the applicant's financial situation after the original application was submitted.

(5) Facts that may have been unknown or unavailable at the time of the applicant's original application for assistance.

(6) Other compelling circumstances that might justify assistance above the two thousand five hundred dollar ($2,500) threshold.
