Sec. 1.

(a) A person who is ineligible for an occupational license under 68 IAC 2-3 because of a felony conviction in accordance with IC 4-33-8-3(2) or IC 4-35-6.5-3(2) may request a waiver under IC 4-33-8-11 or IC 4-35-6.5-11. Upon receipt of the request for a waiver, the commission shall schedule a review on the request for a waiver. A review under this rule is not an appeal of commission action. A review under this rule must be undertaken before the person may request a hearing on a denial of the person's application for occupational license under 68 IAC 7-1.

(b) A petitioner may request a waiver of the requirements of IC 4-33-8-3 or IC 4-35-6.5-3 only if a casino licensee indicates, in writing, that it would employ the petitioner upon the issuance of a waiver.

(c) A petitioner shall submit the original of a request, pleading, or other written document submitted to the commission or the review officer, or both.

(d) An action involving a request for waiver under this rule must also comply with IC 4-21.5-3.
